Bannockburn Kitchen Terms

By visiting the Taste Buds Kitchen website, registering for a class, booking an event, or purchasing items from the online store, I (the “client”) acknowledge that I have carefully read, understand, and accept the terms and conditions of this notice (the “Agreement”).

Acknowledgement of Risk & Waiver of Liability

I (the “client”) acknowledge and agree that: (i) I have the right and ability to waive all rights and legal claims against both Whisk Taker, LLC DBA Taste Buds Kitchen and Taste Buds Kitchen International LLC (collectively, “TBK”) and their affiliates on behalf of the participating and booking client, (ii) I hereby acknowledge, agree and understand that the use of TBK facilities, services, equipment or premises (“Cooking Services”), involves risks of injury to my person and property, as well as to that of a minor for whom I have guardianship and have requested entrance and use of the Cooking Services. I acknowledge, agree and understand that risks involved in the Cooking Services includes, but is not limited to cuts, falls, burns, allergic reactions and other risks associated with preparing and consuming food. By engaging in the Cooking Services, or permitting the use by such a minor, I assume full responsibility for such risks. (iii) Therefore, on behalf of myself, my heirs (including minors whom I have requested to be allowed to use the Cooking Services), personal representatives or assigns, I do hereby release, waive, hold harmless, and covenant not to sue TBK, its successor(s) or related entities, directors, officers, employees, volunteers, independent contractors, or agents from any liability and all claims arising from my (or the minor for whom I am the guardian) use of the Cooking Services. This waiver of all claims includes, but is not limited to, personal injury (including death) from accidents or illness, medical conditions, claims, liabilities, expenses or judgments, including attorneys’ fees and court costs arising out of or relating to the Cooking Services, as well as any and all claims resulting from damage to, loss of, or theft of personal property. I understand that I am releasing TBK, its successor(s) or related entities, directors, officers, employees, volunteers, independent contractors, or agents from all liability to me, my heirs, minor children for whom I am responsible, and our assigns, for any loss or damage to me or the child, and forever give up any claims therefore on account of injury to person or property whether caused by the active or passive negligence of TBK. (iii) In the event of emergency, I give my consent to TBK and affiliates, employees, volunteers or independent contractors to provide medical care to me (or any minor for which I am responsible) and give authority to any emergency personnel to render immediate aid.

This Agreement shall be treated as though it were executed and performed in the State of Illinois and shall be governed by and construed in accordance with the laws of the State of Illinois (without regard to conflict of law principles). Should a dispute arise concerning the terms and conditions of this Agreement or the breach of same, the maximum liability of TBK and the covered parties to client or to any third-party, in the aggregate, under any and all circumstances will be equal to any fees that the client have paid to TBK for the service. The parties agree to submit their dispute for resolution by arbitration before the American Arbitration Association. Any award rendered shall be final and conclusive to the parties.

Cancellation Policy

No refunds are offered but we know that life happens and we are here to help you.

Public Registration Events: We have a firm 72-hour cancellation policy. If you let us know ahead of this window, we’d be happy to move you to another event for a $5 admin fee per registration to ensure that we have enough time to re-fill your seat with another student. While it is not in our nature to say no, we are simply not able to offer credit for last-minute illnesses or scheduling conflicts. You are however, always welcome to send someone in your place (and we hope that you do). Reschedule credits expire 6 months from the original date of purchase.

Privately Booked Events: Your deposit exclusively reserves our Kitchen on the date and time selected at booking. If you’d like to reschedule your event, a new deposit is always needed. If you need to cancel your event (and we really hope that you don’t), you may do so at anytime but please keep in mind that your deposit is non-refundable and cancellations made within 7 days of your event will be charged in full.

On rare occasions TBK will have to reschedule or cancel an event. In these situations, you will be contacted at the contact information provided along with a credit towards a future event or a refund.

Photography & Multi-Media Policy

I agree that photographs and videos taken by TBK agents during events are the property and exclusive copyright of TBK and can be used for publicity purposes. I agree and that no compensation will be given for the use of this media. If I do not wish photographs or videos of my child to be taken, I will notify the office in writing prior to the event.

Trademark Information

Taste Buds Kitchen and Cupcake Kids! are registered trademarks of Taste Buds Kitchen LLC. Whisk Taker, LLC has been granted the authority to use these registered trademarks. All other trademarks, service marks, and product names used herein are the property of their respective owners.

Privacy Policy

TBK values its customers and respects their privacy. We collect customer information in an effort to communicate with you about upcoming events, workshops, news, contests and promotions. We do not sell, rent or give your name, address or any other personal information to anyone. Once subscribed, you may opt-out of our email updates at any time by using the unsubscribe mechanism within the email or by contacting us directly.
